CLIENT AGREEMENT — The terms of the following agreement are issued by Kelli Radwanski (KR) and Client and represent a legal and binding contract between photographer and participating subjects. By entering into this agreement both parties agree to materially uphold all terms. RESERVATION — Upon booking, KR will reserve your date. For this reason, your retainer is non-refundable, even if the date is changed or the shoot is canceled for any reason. Cancellation retainers may be used toward future credit with KR. Your retainer fee due at contract signing and is applied toward your total package. PAYMENT — The fee amount described in this agreement is according to your purchased product on kelliradphoto.com; your remaining balance is due on shoot day after services are rendered or otherwise automatically applied to subscription and/or payment plan products. NON-GUARANTEE — Although every possible care is taken with your photographs, should unforeseen, uncontrollable circumstances occur resulting in lost, stolen, damaged or destroyed images, KR liability is limited to a full refund. COPYRIGHT — The photographs and physical prints produced by KR are protected under Copyright Law (all rights reserved). Upon final payment by Client, limited copyright ownership of images is transferred to clients under the following conditions: images are to be kept intact without any digital or physical alternation; images are the property of the client for personal use only, and for reproduction and distribution to friends and relatives. Images may not be sold or professionally published without permission. MODEL RELEASE — By signing, Client hereby grants KR the irrevocable and unrestricted right to use and publish photographs of the Client for editorial, advertising and promotion purposes or in any manner or medium and to alter the same without restriction. It is agreed that KR may use photographs on social media, websites, in contests, awards, books and any other professional purposes. EDITING & SELECTION — KR will organize your photographs for digital presentation, deleting duplicates and images deemed to be technically subpar. The selection process is the discretion of KR; KR retains the right to withhold or edit any image. SEVERABILITY — If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect. VOLUNTARY PARTICIPATION — You hereby acknowledge and agree that you will voluntarily be participating in certain physical activities on our photo shoot; the activities may include walking, climbing, sitting and various posing; you understand and are aware that your participation in the photo shoot involves risks which may lead to tangible or intangible harm, and you agree that they may result not only from your own actions but also from the actions of others; with the knowledge and understanding of these risks, you choose, of your own will and volition, to continue participating in the photo shoot. You also acknowledge and agree that there are risks that you may not have considered, yet you waive your right to any claims that may occur from these unconsidered risks and choose, of your own will and volition, to participate in the photo shoot; you acknowledge and agree that by voluntarily pariticpating you waive certain legal rights, including the right to sue KR for any physical, material, tangible or intangible, loss or damages that may happen to you during your participation in any of the photo shoot. ENTIRE AGREEMENT — This agreement contains the entire understanding between KR and Client. The only way to change this agreement is to do so in writing, provided the document is signed by both parties. It is Clients responsibility to notify KR of any changes in plans or contact information as listed in this contract. I have read and understood the above and agree to the terms of this agreement.
